Terms of Service

1. Acceptance of Terms

By accessing or using EcomSosse ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Joel Voelkel (sole trader), Hohensteinstr. 43, 44866 Bochum, Germany ("we", "us", or "EcomSosse").

2. Description of Service

EcomSosse is a profit tracking and analytics platform for e-commerce merchants. The Service connects to your Shopify store and advertising accounts (Meta Ads, Google Ads, TikTok Ads) to calculate and display profit metrics within your private dashboard. EcomSosse is provided as a software-as-a-service (SaaS) application accessible via web browser.

3. User Accounts

To use EcomSosse, you must create an account with a valid email address and password. You are solely responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Ensuring that your account information is accurate and up to date.

You must notify us immediately at info@getshameless.de if you suspect unauthorized access to your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or used in violation of these Terms.

4. Acceptable Use

When using EcomSosse, you agree not to:

• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service to process data that you do not have the legal right to access.
• Use the Service in any manner that could damage, disable, overburden, or impair our servers or infrastructure.
• Attempt to gain unauthorized access to any part of the Service or its underlying systems.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Resell, redistribute, or sublicense the Service or any data obtained through it without our prior written consent.

5. Third-Party Integrations

EcomSosse integrates with third-party platforms including Shopify, Meta (Facebook), Google, and TikTok. By connecting these platforms to EcomSosse, you confirm that you have the right to grant EcomSosse read access to the relevant data and that you agree to comply with the respective terms of service of each platform:

EcomSosse accesses third-party platforms in read-only mode for the purposes described in our Privacy Policy. We are not responsible for the availability, accuracy, or changes to third-party APIs or services.

6. Data Ownership

You retain full ownership of your business data — including your Shopify order data, advertising data, product costs, and any other data you enter into EcomSosse. We do not claim ownership of your data. We process it solely to provide the Service as described in our Privacy Policy. You may export or request deletion of your data at any time.

7. Intellectual Property

The EcomSosse platform, including its design, code, and content, is owned by Joel Voelkel and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your own internal business purposes. No other rights are granted.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that the profit metrics displayed are completely accurate. The calculated figures are based solely on the data provided by you and the connected platforms. You are responsible for verifying the accuracy of your inputs.

9. Limitation of Liability

To the fullest extent permitted by applicable law, EcomSosse and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business opportunities — arising from your use of or inability to use the Service. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to EcomSosse in the twelve months preceding the claim.

10. Termination

You may terminate your account at any time by contacting us at info@getshameless.de. Upon termination, your access to the Service will cease and your data will be deleted in accordance with our Privacy Policy. We reserve the right to terminate or suspend your account if you violate these Terms, with or without prior notice.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice within the Service. Your continued use of EcomSosse after the effective date of the updated Terms constitutes your acceptance of the changes.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Bochum, Germany, to the extent permitted by applicable law.
